1. All horses are offered for sale according to the laws of the State of Texas. Each animal will be sold to the highest bidder; however, the right to bid and/or repurchase the horse is reserved by all consignor sellers. 2. ALL HORSES ARE SOLD WITH CLEAR TITLE, BUT ARE OTHERWISE BEING SOLD “AS IS”, “WITH ALL FAULTS” WITH NO EXPRESS OR IMPLIED WARRANTIES OF ANY KIND AS TO SOUNDNESS OR CONDITION, UNLESS AN EXPRESS ANNOUNCEMENT TO THE CONTRARY IS MADE FROM THE AUCTION BLOCK ON BEHALF OF THE CONSIGNOR SELLER. POTENTIAL BUYERS ARE URGED TO CAREFULLY EXAMINE ANY HORSE AND TO CONDUCT ANY EXAMINATIONS THAT ARE DESIRED OR DEEMED NECESSARY PRIOR TO PURCHASE. 3. Any buyer right of recourse is only directly to the seller and not through the sale management. Sale management, auctioneers and their employees do not act as agents for or represent any buyer or seller and do not assume any liability for either the buyer or the seller. 4. The highest bidder is to be the buyer. If any dispute arises between or among two or more bidders, the auctioneer has sole authority to settle the dispute. The auctioneer’s decisions shall be final. The auctioneer reserves the right to reject any and all bids. 5. Terms of the sale are cash, and payment in full must be made to the cashier in the Horse Sale Office during or immediately after the sale. Payment must be in the form of cash, cashier’s check, personal check or credit card (with 4% processing fee) (U.S. currency only). Proper identification is required on all checks. 6. Title passes to the buyer at the final fall of the auctioneer’s gavel declaring the animal sold. At such time, buyer assumes all risk of loss and the responsibility, maintenance, care and expenses of the horse. Buyers are encouraged to contact seller immediately to arrange for proper care. Buyers needing transportation for their purchases may contact the Horse Sale Office for assistance. 7. Individual state health requirements should be considered by bidders before purchasing. Horses are offered with an original or copy of a Certificate of Veterinary Inspection within 30 days and a proof of a negative Coggins Test within the last six months. 8.
